Focus on Lymphoma Privacy Policy

Welcome to the Privacy Policy for the Focus on Lymphoma mobile application (the “App”).  This Privacy Policy is intended for App users, including individuals who have been diagnosed with lymphoma and their caregivers (“you/your”).  This Privacy Policy explains how your information is collected, used, shared, and protected by the Lymphoma Research Foundation and its affiliates (including its employees and contractors, “we/us/our”) when you use the App. 

The App provides users with comprehensive content based on specific lymphoma subtypes and tools users can use to help manage their treatment.  The App is designed to collect data related to your treatment and can share this information with your selected health care providers upon request.  The App provides a personal health record that is managed, shared, and controlled primarily by and for you.   

Please read this Privacy Policy carefully and be aware that by accessing and using the App and accepting this Privacy Policy, you agree that you have read this notice and that you accept and consent to the practices described here.  Use of the App is also governed by and subject to the Terms & Conditions of Use (“Terms of Use”).  Additionally, to use the App, you must accept the User Authorization for Use & Disclosure of Information (“User Authorization”) within the App, which authorizes certain uses and disclosures of information related to your use of the App.  

Data Collection and Use: Through your use of the App and your communications with us, Lymphoma Research Foundation collects certain Personal Information, which includes:  (1) information you provide through use of the App; (2) information you provide in response to surveys; (3) user information that we automatically collect; and (4) information collected through the use of cookies. When we use the term “Personal Information,” we mean information that we directly or indirectly associate with a specific person, or that can reasonably be used to identify a specific person, such as a name, address, phone number, or email address.  Personal Information includes the following:  

  • Information You Provide Through Use of the App.  The App prompts you to provide certain information when you first download and launch the App.  For example, when you create your account on the App, you will be asked to provide information including your name, email address, and zip code.   

You also have the option to use the App to provide information about your lymphoma treatment or the lymphoma treatment of a person for whom you are a caregiver, including lymphoma subtype, medications, treatment symptoms, blood work results, and appointments with health care providers.   

We will use information you provide through the App to support the App’s core functions and provide related services.  For example, we will use this information to enable you to log into the App and to help you with the App when you request assistance.  The App may use any such information you provide to send you information about the App.   

  • Information You Provide in Response to Surveys.  From time-to-time, we may ask you to provide information about your experience with the App or your lymphoma treatment through surveys.  We will use your responses for purposes such as helping us improve the App and related services.   
  • User Information That We Automatically Collect.  When you use the App, we may also collect information about your App use, including which sections of the App you visit, which articles you read, and how frequently you log into your account.  We may also collect technical information such as log file data, Internet Protocol (IP) address, and device identifier.  We work with partners, such as Google Analytics, to collect and analyze this information.  This information is used for purposes such as supporting the App, improving the App’s features and functionality, and improving other Lymphoma Research Foundation programs and services.  
  • Cookies.  Lymphoma Research Foundation or Google Analytics may place cookies or other similar technologies on your smartphone.  We may use these technologies for purposes such as helping us understand how the App is used, improving the App, and personalizing your App experience.  While the App does not respond to web browser “do not track” signals, we do not track (nor do we permit third parties to track) your online activity over time across third-party websites.  You can find out more information about Google Analytics cookies here

The App provides contact information for the Foundation Helpline.  If you call the Foundation Helpline, you may provide information to a Foundation representative, such as your contact information and information relating to your lymphoma treatment.  This Privacy Policy does not govern information the Foundation collects when you call the Foundation Helpline.  Such information is governed by the Lymphoma Research Foundation Website Privacy Policy

How We Use and Share Your Personal Information: We use and share your Personal Information as described in this Privacy Policy.  In general, we use and share your Personal Information as permitted or required by applicable laws, rules, or regulations, and for purposes relating to the operation of the App.  We may use Personal Information for management and administration purposes.  We do not sell your Personal Information.  We may use and share your Personal Information as follows: 

  • To Maintain and Improve the App.  We may use and share your Personal Information to provide services to you through the App, to improve the App, and personalize features of the App.  We may share your Personal Information with vendors that we use to provide services related to the App.  We will use reasonable efforts to limit vendor access to your Personal Information to only what is reasonably necessary under the circumstances.  We seek to use vendors that provide reasonable assurances that they will only use and disclose your Personal Information in a manner that is consistent with applicable law and the terms of this Privacy Policy, and that they will implement reasonable and appropriate security safeguards that are consistent with applicable law. 
  • With Your Authorization.  We may use and share your Personal Information as allowed under any valid authorization provided by you, including the User Authorization.   
  • To Communicate With You.  We use your Personal Information to send you notifications through the App and to respond to you when you contact us.  We may also use your Personal Information to send you emails with information related to your use of the App, such as information regarding lymphoma research, patient education events in your geographic area, and fundraising.  
  • To Help You Communicate With Your Health Care Providers.  When you have provided authorization, we may share selected Personal Information with the health care providers you have expressly authorized to receive access to your information.   
  • To Comply With the Law.  We may use and share your Personal Information with third parties if we believe that an applicable law, rule, or regulation requires us to do so, including to comply with a subpoena or similar legal process.   
  • To Protect Our Legal Rights and Prevent Harm.  We may use and share your Personal Information with third parties to establish, protect, or assert our legal rights, or to defend against legal claims.  We may also use and share your Personal Information with third parties when we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, or situations involving potential threats to the physical safety of any person. 
  • To Create De-Identified and Aggregated Data.  We may use your Personal Information to create de-identified and aggregated data.  To create de-identified data, we will remove certain pieces of identifying information.  De-identified data will not contain any information that could be used to contact or readily identify you.  We may combine de-identified data from multiple App users to create aggregated data.  We hold all rights, title, and interest in and to de-identified data.  We reserve the right to use and share de-identified data (regardless of whether it has been aggregated) for any purpose, in our sole judgment.   

For instance, we may use and share de-identified data for the following purposes: 

  • To Improve the App.  We may use and share de-identified data to evaluate the effectiveness of the App, identify trends, and improve operations related to the App.  For example, we may use de-identified data to track which parts of the App users with a certain lymphoma subtype visit most often to determine what additional content may be helpful for those users.    
  • To Improve Other Lymphoma Research Foundation Programs and Services.  We may use de-identified data to evaluate and improve the other Foundation programs and services, including other services that provide information to lymphoma patients and their caregivers.  For example, we may use de-identified data collected from App users to identify topics on which the Foundation could provide additional resources. 
  • To Conduct Research.  We may use de-identified data for research, including analytics and the development of products and services.  Analytics is the process of examining data to draw conclusions from that information.  We may also share de-identified data with third parties for research and analytics purposes.   
  • To Inform Third-Party Partners of Survey Results.  We may share aggregated and de-identified survey responses with third-party partners to keep them informed regarding industry trends.  When we request that you complete a survey, we will include information regarding any third-party partners with whom we will share the results.  
  • In Connection with Organizational Changes.  We may use and share your Personal Information with third parties if the Foundation is involved in a merger, acquisition, sale of all or a portion of its assets, or other restructuring.   

Your Ability to Access and Update Your Personal Information: You may access and update certain Personal Information by using the App.  For example, through the App, you can access and update information such as:  (1) self-reported information relating to your medications; (2) self-reported information regarding your symptoms, including nausea, pain, and fatigue; (3) your self-reported blood count results; and (4) information you input into the App related to your doctor sessions, including recordings and notes.     

  1. Sharing Your Personal Information With Your Health Care Providers: You can use the App to share certain Personal Information with your health care provider via email.  Through the App, you can create a report of your Personal Information maintained by the App and email that report to your health care provider using the email system available on your device.  Please note that you are responsible for inputting a correct email address for your health care provider.  If you input an incorrect email address, your Personal Information may be shared with a stranger.  
  1. Data Storage and Retention: We will retain your Personal Information for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. Retention periods can vary based on the type of information, how it is used, and relevant legal requirements.  We consider the following factors when determining how long we keep your Personal Information: (1) the amount, nature, and sensitivity of the Personal Information; (2) the potential risk of harm from its unauthorized use or disclosure; (3) the purposes for which we process your Personal Information; and (4) whether we can achieve those purposes through other means, and the applicable legal requirements.   

If you would like us to delete any Personal Information, please contact us at [insert email address] and we will evaluate your request and respond.  Keep in mind that your Personal Information may be required for you to have full access to the App, and we may be required to retain certain information by applicable laws, rules, or regulations.  Additionally, Personal Information already shared pursuant to this Privacy Notice or the User Authorization may be used or re-disclosed by the recipient(s) even after we have deleted it, to the extent such use or re-disclosure is not prohibited by applicable law. 

  1. Security: We have taken reasonable steps to secure your Personal Information.  We comply with applicable laws relating to the security of Personal Information.  The App includes physical, administrative, and technical safeguards to protect the confidentiality, integrity, and availability of your Personal Information, and to prevent impermissible uses and disclosures of your Personal Information.   

Please be aware that, although we endeavor to secure Personal Information, no system can prevent all potential security breaches.  A security breach is an unauthorized access, use, disclosure, modification, or destruction of sensitive information.  In the event we discover a security breach, we will provide notice of the breach, including to you and applicable regulators, to the extent required by applicable law.   

  1. Minors: Minor children are not eligible to use the App, and we ask that they do not submit any personal information to us.  We do not knowingly attempt to solicit or receive any information from minor children.  If you are under the age of 18, you are not authorized to access, or to submit any content or information to, the App.  If a parent or guardian becomes aware that a child has provided us with any personally identifiable information through the App, the parent or guardian should contact us at privacy@lymphoma.org.  We will delete such information from our files within a reasonable time. 
  1. Changes to This Privacy Notice: This Privacy Notice may be updated from time to time for any reason.  Should the Lymphoma Research Foundation make any changes to this Privacy Policy, we will post the revised Privacy Policy to the App and the changes will be effective upon such posting.  We encourage you to review the Privacy Policy periodically.  If you do not agree with any updates to this Privacy Policy, do not continue to use the App. Continued use of the App after the effective date of an update to this Privacy Policy constitutes acceptance of the updated terms.

Information Subject to U.S. Laws: Lymphoma Research Foundation is located in the United States, its services are provided in the United States, and its data is stored in the United States.  Our services are not intended to subject us to the laws or jurisdiction of any state, country, or territory other than that of the United States.  Your Personal Information may be stored and processed in the United States where our servers are located and our databases are operated.  In certain circumstances, courts, law enforcement agencies, regulatory agencies or security authorities may be entitled to access your Personal Information.
