The Focus on Lymphoma mobile application (the “App”) is owned and operated by the Lymphoma Research Foundation, Wall Street Plaza, 88 Pine Street, Suite 2400, New York, NY 10005 (together with its business partners and affiliates, “the Foundation”).
Your use of this App is governed by the provisions contained in these Terms and Conditions (the “Terms and Conditions”). Please take a few minutes to review these provisions. Your use, or access, of the App constitutes your agreement to be bound by these provisions. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS YOU MAY NOT ACCESS OR OTHERWISE USE THE MOBILE APP.
Use Of This Mobile App: You may access and use this App solely pursuant to these Terms and Conditions for your personal, non-commercial use.
Consultant A Doctor: The content provided on this App is for informational purposes only and is not intended, and should not be construed, to be a substitute for proper medical advice from a trained physician. You should consult with medical professionals regarding any determination with respect to treatment. Never disregard professional medical advice or delay seeking treatment because of something you have read or accessed through the App.
Registration and Passwords: In order to access services and content on the App, you may be required to register to become a member of the App. You must provide truthful information when signing up to become a member, and may not use any aliases or other means to mask your true identity. Upon successful registration you may create a log-in ID and password. The log-in ID and password provided should be safeguarded at all times. User is responsible for the security of their log-in ID and password and will be solely liable for any use or unauthorized use under such log-in ID and password.
Unauthorized Access: You agree not to attempt to gain unauthorized access to the App or any restricted portion of the App, interfere with the performance of the mobile app, exceed the permitted use, attempt to access any other user’s data or otherwise compromise any aspect of the App. You may not use spiders, robots or other automated data mining techniques to catalog, download, store or otherwise reproduce, store or distribute content available on the mobile app. You may not take any action to interfere with the App or any other user’s use of the App, including, without limitation, via means of overloading, “flooding”, “mailbombing” or “crashing” the App. You may not send unsolicited communications (i.e. email, push notification, chat message, etc.), including promotions and/or advertising of products or services, through the mobile app or forge or mask your true identity in any communications or posting. User may not frame portions of the mobile app within another App or digital property or establish links from any other App or digital property to any page of the App other than the use of the App’s share features or without the prior written consent of the Lymphoma Research Foundation.
Proprietary Rights: All pages and content within this App, including but not limited to, the software which operates the App, text, graphics, audio, video, photographs, articles or other materials, are the intellectual property of, or are authorized for use by, the Lymphoma Research Foundation and its licensors, business partners and affiliates. Except as expressly permitted in these Terms and Conditions, you may not modify, copy, reproduce, republish, upload, post, transmit, or distribute in any way content available on this App without the prior written consent of the Foundation.
Information: Any information you provide or upload through this mobile app must be truthful information and you may not use any aliases or other means to mask the true identity of any party. You may not upload any information regarding another person or entity without the express permission of that party. Except as expressly stated herein or in the Privacy Policy, no obligation shall be imposed upon the Lymphoma Research Foundation as a consequence of any communication solicited or received by it through the App. You agree to defend, indemnify and hold harmless to the Foundation from any third party claims as a result of personally identifiable information provided by you to the Foundation in violation of these Terms and Conditions or applicable law.
Changes: All information posted on the App is subject to change without notice. In addition, these Terms and Conditions may be changed at any time without prior notice. We will make such changes by posting them here. You should check this page for such changes frequently. Your continued access of the App conclusively demonstrates your acceptance of those changes. Additional terms may apply to specific Lymphoma Research Foundation programs in which you participate.
Disclaimer: The App, including all content made available on or accessed through the mobile, is provided “as is.” To the fullest extent permissible by law, the Foundation and its employees , representatives, agents, affiliates, contractors, business partners and other entities that assist in providing this App (the “Lymphoma Research Foundation parties”) make no representations or warranties of any kind whatsoever for the content or the mobile app. Further, the Foundation parties disclaim any express or implied warranties, including, without limitation, non-infringement, title, merchantability or fitness for a particular purpose. The Foundation parties do not warrant that the functions contained in the App or any materials or content contained therein will be uninterrupted or error free, that defects will be corrected, or that the App or the server that makes it available is free of viruses or other harmful components. The Foundation parties shall not be liable for the use of the App, including, without limitation, the content and any errors contained therein. In no event will the Foundation parties be liable under any theory of tort, contract, strict liability or other legal or equitable theory for any lost profits, lost data, lost opportunities, costs of cover, exemplary, punitive, personal injury/wrongful death, special, incidental, indirect or other consequential damages, each of which is hereby excluded by agreement of the parties regardless of whether or not either party has been advised of the possibility of such damages. In addition, in no event shall the total liability of the Foundation parties arising from or relating to your use of this App exceed the amount paid by you relating to such use or one (1) dollar, whichever is greater.
Links: The App may contain links to, or may frame, other digital properties not maintained by Lymphoma Research Foundation. Other digital properties may also reference or link to the App. The Foundation encourages you to be aware when you leave the App or view framed digital properties and to read the privacy statements of each and every digital property that you visit. The Foundation is not responsible for the information collection, privacy practices or content of such other sites.

Severability: If any part of these Terms and Conditions shall be held or declared to be invalid or unenforceable for any reason by any court of competent jurisdiction, such provision shall be ineffective but shall not affect any other part of these Terms and Conditions.
Governing Law. The laws of the State of New York shall govern these Terms and Conditions. YOU HEREBY EXPRESSLY CONSENT TO EXCLUSIVE JURISDICTION AND VENUE IN THE COURTS LOCATED IN NEW YORK COUNTY, NEW YORK.
